Preamble
The following General Terms and Conditions of Use (hereinafter the “CGU”) govern the relations between the company called “SOCIETY OF DISTRIBUTION OF MECANICAL BODIES”, limited liability company united to the capital of 500.010 Euros whose head office is located 259 Chemin des Clapiers 83220 LE PRADET, registered in the Register of Trade and the Companies identified by TOULON.
Article 1. Subject
The purpose of these Terms is to legally regulate the use of the Site and the services contained therein.
Access to the Site by the User shall take full acceptance by the User of these Terms.
Article 2. Editor
The publication of the Site is carried out by the company called “SOCIETY DE DISTRIBUTION D’ORGANES MECANIQUES”, a limited liability company with a capital of 500.010 Euros whose head office is located 259 Chemin des Clapiers 83220 LE PRADET, registered in the Register of Trade and Companies of TOZULON under the number 391 011 111 and identified in the Repertoire SIRE.

Article 4. Access and content of the Site
The Site offers the User a simple, quick and free access to information about products marketed by the Company.
All necessary fees to access the Site (e.g. internet connection, computer hardware etc.) are to the exclusive charge of the User.
Users who have created an account on the Site can access the services available in their customer area using an identifier and password.
It is up to the User to ensure that it has adequate protection against computer viruses. In any event, the Corporation cannot be held responsible for the intrusion by third parties in the User’s computer system and/or the interception by third parties of the data transmissions made during the use of the Site.
The User acknowledges that access to the Site may be temporarily interrupted or suspended by the Corporation without notice or justification, due to unpredictable events or maintenance-related problems.
Article 5. Personal data
The Company conducts a processing of data provided by the User in strict compliance with French legal provisions and European data protection regulations.
The User is informed that he has the right to access, rectify, delete and oppose his personal data. The exercise of this right is done directly via its personal space on the Site or by making its request by e-mail at the following address: info@dom-france.fr.
Article 6. Security
The Corporation shall implement all reasonable and necessary means to secure the Site and to limit any possible disruption.
However, the Corporation cannot guarantee the total exclusion of any malicious technical manoeuvres or intrusion of any third party.
Article 7. Accountability
In no case shall the Company be held responsible for the use and interpretation by the User of the information provided on the Site; technical errors that may arise and maintenance-related issues.
The User will do his personal business with any virus that may infect his or her computer hardware after the use or access to the Site; any intrusion by third parties in the User’s computer system and any interception by third parties of the data transmissions made during the use of the Site.
In no case shall the Corporation be held liable for force majeure as defined in article 1218 of the Civil Code or for the unpredictable and insurmountable fact of a third party.
In general, the Corporation shall not be liable for any direct or indirect damage arising from the use of the Site or any information emitted on the Site, nor for any loss of any data of any kind.
Article 8. Hypertext links
The User is informed that the Site may contain hyperlinks to other sites on which the Corporation does not exercise any control.
The User acknowledges that the Corporation cannot offer any warranty regarding the content, security and reliability of these sites.
In any event, the Corporation cannot be held liable for any direct or indirect damage arising from the use of these sites. The User will do his personal business with the discretion of these sites.
Article 9. Cookies
The User is informed that the automatic installation of a cookie on the User’s navigation software may occur when using the Site.
The User can at any time accept cookies or disable them via the navigation software settings.
Article 10. Intellectual property
In any event, all copyrights, trademarks and other intellectual property rights relating to any information contained on the Site remain the exclusive property of the Corporation.
The entire content of the Site, without any exceptions or reservations, remains the exclusive property of the Corporation.
In no case shall their disclosure by the Company be construed as any right of use by the Customer or third parties.
Thus any copy, reproduction, republication, transmission, distribution and use in any way, documents from the Site are expressly prohibited.
Article 11. Changes to TUCs
The Corporation reserves the right to modify and revise these MTCs at any time.
Subject to a legal or otherwise prescribed provision, applicable GTCs are those available on the Site.
Article 12. Applicable law and jurisdiction
The use of the Site and any other elements accessible on the Site are subject to the mandatory provisions of the contrary.
In the absence of an amicable agreement between the Corporation and the User, any dispute arising out of or related to the use of the Site or any other matter accessible on the Site shall be subject to the competence of the competent French courts, unless otherwise provided by law in return to the mandatory jurisdiction of a foreign jurisdiction.
